The West Bengal Calcutta high Court has today recommended the most tragic case of the chilling obnoxious rape and subsequent brutal murder of a 31 year old doctor to the country’s premier investigative agency CBI during the first hearing of the matter saying that since the matter comes under the category of the rarest of the rare case and the state government and its police has not made any significant progress in the probe there is every possibility of the destruction of the evidences of this most sensitive case.

There have been tremendous spate of protests by the doctors and common public in West Bengal with people in social media also condemning this most brutal act of rape and murder in strongest possible terms urging for recommending the case for the CBI probe and subsequent stringent punishment equivalent to capital punishment to the guilty.

Meanwhile, Yogita Bayana, anti rape activist fighting for justice to the raped and tortured women, girls and children has urged the powers that be punish the guilty of the rarest of the rate crimes in the country at the earliest.

Referring to the most obnoxious rape and murder of an adolescent in Muzaffarpur in Bihar apart from the tragedy of the Bengal doctor she wrote on X : Bigger brutality than “Nirbhaya”! A 14 year old girl was kidnapped from her home, gang-raped, her breasts were cut off, her private parts were stabbed 40 times and she was brutally murdered! Be it Kolkata, Bihar or Rajasthan, the situation is the same in the entire country said Bayana who fights for justice to the tortured and oppressed women and girls.

According to the latest news the chief minister of West Bengal Mamata Bannerjee has given six days ultimatum to the Bengal police to complete the probe into the most obnoxious rape of the doctor in a state government run hospital n her brutal murder failing which she will give the case to the CBI.

The incident has shaken the Bengal government and its police department and there have been spate of protest demonstrations in various parts of the state with media highlighting this issue to the hilt.

In view of the multiple litigations filed in Calcutta High court by several petitioners including a BJP leader of opposition Suvendhu Chowdhary the high court bench led by chief justice T.S.Shivagnanam noted that there had been no significant progress in the case so far which gives an impression that the evidence in the case can be tempered with.

The chief justice also took to task the state government hospital administration and slammed the former principal whose first resignation and then swift reinstatement in a key role has sparked the row inviting massive protests and demonstrations in the state.

The court’s directives noted that petitioners have emphatically pointed out in their petitions about injuries on the victims body and even the chief minister has no objection if the investigation of the case is passed on to the CBI for deeper probe.

The traumatised parents of the victim wanted the CBI probe under the monitoring of the High court so that no evidence is tempered with and impartial justice delivered to them expeditiously.

The apprehensive parents of the deceased also wanted their safety, safety of the witnesses and all those connected with the case fearing retaliation from the culprits.

Refering to various such cases of Supreme Court the High Court chief justice said that the Court would exercise its constitutional powers for transferring the case from the state investigation agency to any other independent agency or the CBI, this being the rarest of the rate case.

It also noted that since the state police lacks its credibility it is necessary to have a fair, impartial, transparent and complete investigation by the agency like Central Bureau of Investigation said the chief justice of Kolkata High Court leading the bench.
