Apex court turns, down the appeal of Hindu Sena against AAP, BSP, Congress and SP saying heavy penalty should be imposed on such petitioners with ulterior motive
Announcing freebies during election campaigning to elicit the support of electorates and making assurances of fulfilling their demands including making tall promises or announcing populist measures is not objectionable or against law in the eyes of the Supreme Court of India and any appeal or petition challenging this act will not be entertained by the Apex court as the top court of the country has rejected the plea filed by a petitioner of Hindu Sena Surjit Singh Yadav terming it as ulterior in motive with the aim to target and harm selected parties keeping aside rest of the political parties including the party in ruling without naming them.
Giving the significant decision turning down the petition of Hindu Sena, petitioner namely Surjit Singh Yadav, the chief justice as member of the three judge bench N. V. Ramanna said that he and two other justices viz justice A. S. Bopanna and Justice Hema Kohli are of the clear cut opinion that the petitioner has ulterior political motive in mind to selectively target and harm few political parties and as such, such petitions should be dismissed with imposing heavy penalties against the petitioners.
Filing the petition in the Apex court, the Hindu Sena chief Surjit Singh Yadav had accused Aam Admi Party, Samajwadi Party, Bahujan Samaj Party and Congress of announcing free bies and various concessions etc during elections of the five states amounting to corrupt practices etc saying that it is against the clause 123 ( 1) ( A) of the IPC.
He has appealed to revoke the registration of these political parties and lodge FIR against their leaders to penalise them.
The advocate Varun Sinha was fighting this case on behalf of Surjeet Singh Yadav of Hindu Sena who had on Wednesday appealed to the honourable CJ and two other judges to hear this case urgently.
However, after the three judge bench of Supreme Court comprising of chief justice N. V. Ramanna, justices Bopanna and Hima Kohli quashed the appeal of Hindu Sena saying that such petitioners should be heavily charged as penalty and discouraged in future not entertaining their appeals who are ulterior in motive to harm selective political parties, the advocate of Hindu Sena pleaded that it is an NGO having no political connections and if need be he is ready to take out the names of political parties but want to file it again. But the three judge bench refused to budge saying that it is not that they don’t want to hear the petition but they are not interested to hear such petitions with ulterior motive to harm selected parties. Therefore it can’t be entertained.
They catagorically said that such petitions are not worth hearing.
It may be recalled that even the ruling political party BJP had been making such tall promises during elections apart from other parties viz making announcement of over ambitious huge projects worth lakhs of crores n pledges to bring black money from Swiss Bank including two crore employment to youths every year as promised before the general election of 2014 and the spate of such announcements still goes on.
The recent freebies like tabloids, scooties, mobile phones and concessions of electric tariff etc were the order of the day announcements in the recently held assembly elections by all political parties.
The whole world knows it but the petitioner of Hindu Sena has selected few parties forgetting other parties compelling the honorable learned judges to turn down the appeal
