Rahul Gandhi disqualified after being sentenced for two years by Surat Court though had got bail yesterday!
While Congress party, its leaders and rank and file nationally – being stunned and saffron party leaders and activists in jubilant mode of course ( as it seems to be) after Rahul was convicted, the Secretary General of Lok Sabha Utpal Kumar Singh acting on the constitutional provisions of Representation of the People’s Act has disqualified the Waynad MP and former Congress chief Rahul Gandhi from the membership of Lok Sabha after being convicted by a Surat Court yesterday over his derogatory remarks over Modi Surname uttered by the former while addressing a rally in Karnataka during national elections in 2019. The disqualification order signed by the secretary general Lok Sabha says : Consequent upon his conviction by the Court of Chief Judicial Magistrate Surat in C C /18212/2019 Shri Rahul Gandhi , Member of Lok Sabha representing the Waynad parliamentary constituency of Kerala stands disqualified from the membership of Lok Sabha from the date of his conviction i. e. 23 March, 2023 in terms of the provisions of Article 102 (1) (C) of the Constitution of India read with Section 8 of the Representation of People’s act 1961.
Feeling extremely irked and angered over Rahul Gandhi’s statement allegedly accusing Modi surname persons as thieves, including PM Modi, a former Gujrat minister and currently MLA of BJP Purnesh Modi had filed a case in the Surat Court.
The Court has convicted Rahul Gandhi and sentenced him to two years imprisonment but the Congress leader had got the bail immediately for thirty days enabling him file appeal in higher Court to seek relief.
According to the latest news as per the speaker’s, order Rahul Gandhi…… stands disqualified from the membership of Lok Sabha from the date of his conviction, a notice from the national parliament said on Friday creating sort of political upheaval in Congress and opposition circles.
Yesterday some of the top leaders including the PM Narendra Modi and Defence Minister Rajnath Singh etc had met the Speaker after the Surat Court order and the Speaker Om Birla had termed this meeting as just a courtesy call.
The Congress party has termed this action as purely politically motivated which sparks of vendetta and nothing else. The Congress party in a tweet in Hindi termed the decision to revoke the parliament membership of Rahul Gandhi as a conspiracy as he is relentlessly fighting for justice from roads to parliament further adding that they will continue their fight n struggle till the end including taking judicial justifiable action in the matter.
Meanwhile, according to news an advocate of Supreme Court Vineet Jindal had also complained to the Lok Sabha speaker seeking disqualification of Rahul Gandhi as an MP from Waynad, Kerala after his sentence by Gujarat, Surat Court for two years in prison. The complaint by advocated Jindal mentioned that Congress leader Rahul Gandhi stands disqualified on his conviction under the Representation of People’s Act.
The speaker is believed to have sought the legal opinion in this matter says the news report.
After the judgement Rahul Gandhi was given a rousing welcome at Delhi Airport by his supporters and party leaders and MPs and had tweeted after the judgement quoting Mahatma Gandhi that my religion is based on truth and non violence. Truth is my God and non violence the medium to seek it ( Truth and God) tweeted Rahul Gandhi.
He today tweeted in Hindi : I am fighting for the voice of the country and am prepared to face any nature of consequence.
Meanwhile, hectic political meeting has already started at AICC headquarter 24 Akbar Road in which Sonia Gandhi, Party chief Mallikarjun Kharge, Ambika Soni, Rajiv Shukla, Jai Ram Ramesh, P.Chidambaram, Anil Shastri, Anand Sharma, Priyanka Gandhi, K C. Venugopal, n all senior leaders are deliberating on this development.
Several Congress leaders have courted arrests at several places but Rahul Gandhi is absent in this important meeting having just left his house for an unknown destination.
Not only this but Bengal chief minister Mamata Banerjee has also condemned the action against Rahul Gandhi disqualifying him from Lok Sabha including Arvind Kejrival and Akhilesh Yadav too expressing their solidarity with Congress leader.
The Congress chief Mallikarjun Kharge has while strongly condemning the action accused the ruling party of stifling the voice of free speech and imposing dictatorship.
There are also reports of Rahul Gandhi being pressurised to vacate his house within one and a half months. His name in Parliament seat has also been taken out as Waynaad MP.
There are also reports of Congress party organising demonstrations in all the states of the country and subsequent courting of arrests by its thousands of activists from tomorrow onwards.
Kindly recall that former Prime minister Indira Gandhi whose membership was cancelled in 1977 and during Janata Party rule was publicly handcuffed while being paraded had staged a huge come back with massive majority after just 22 months failing the then Janta Party government – a conglomeration of diverse ideological factions.
Similarly, Congress party this time compares the present situation with Rahul Gandhi’s late grand mother’s situation during Janata Party rule and hope to encash this opportunity politically to stage a come back to power during 2024 national election to be held exactly after 335 days from now.
Congress leader Priyanka Gandhi among other tweets mentioned about thousand of crores taken out of the country by Lalit Modi, Neerav Modi and Mehul Chowksi totalling to Rs 27,925 crores in one of her tweet further asking those who’d looted the nation’s money ( public exchequer) why has BJP come out in their support? Why is it running away from probe? Those who are raising questions on these issues are being wrapped with court cases. Is BJP supporting the corrupters questioned Priyanka Gandhi in her tweet.
The BJP chief J. P. Nadda reacting to Rahul’s disqualification and conviction said that he is arrogant and repeatedly hurt the sentiments of the OBC.
