Two PAC personel held guilty for dreaded rape and firing on the peaceful movement activists at Rampur Tiraha thirty years ago. Sentenced to life with rigorous punishment
#Justice Delayed is Justice Denied is a usual saying and in our country, there are thousands, even lakhs of cases lying pending in various courts awaiting justice and in many cases the plaintiff and appellant die by the time justice comes to their doorstep.
Yesterday, in Uttarakhand, and elsewhere all those who fought for justice for the gruesome victims of 1994 Mujaffarnagar Trijunction tragedy in which 7 movement activists of Uttarakhand had died due to bullet wounds and several hapless women allegedly raped in the fields on the most deadly night while coming in buses to participate in the Red Forty rally from Garhwal, Uttarakhand, were tight lipped though must be jubilant to an extent when two obnoxious policemen of Provincial Armed Constabulary of UP were fined Rs one lakh and sentenced to life imprisonment after protracted thirty years by the Additional Sessions Judge Shakti Singh.
However, the alleged real culprits – the then DGP and DM etc named by the Uttarakhand protestors as the real culprits who ordered indiscriminate firing on the peaceful inhabitants of Garhwal, Uttarakhand are scot free having served with CMs and union ministers and now superannuated. This is most aweful.
According to the latest report pouring in while delivering the important judgement the ADJ Shakti Singh said that the dreaded Rampur Trijunction tragedy that occured in 2 nd October 1994 on the birth anniversary of Father of the Nation is an obnoxious act that is utterly shameful for the entire humanity.
Delivering the the 108 page judgement , justice, ADJ Shakti Singh said that inflicting of this really obnoxious act on the peaceful women and men activists of a separate state movement by committing sexual assault, eve-teasing, rapes with women on the day, the birth anniversary of saint of peace who inspired millions of our countrymen to seek independence Mahatma Gandhi falls – is an utterly shameful act that degrades humanity and leads to hang out heads in shame. He said every person has the right to peacefully protest to raise their voice in favour of separate state. The administration has done barbaric and inhuman act with these peaceful movement activists for no fault of theirs.
The policemen do not have the right to inflict physical injuries or commit immoral acts like rape on them and if the culprit is a policemen than his it becomes more cruel warranting strictest of the punishment ruled the ADJ Shakti Singh further saying that the culprits being policemen had a wider responsibility to safeguard them. If the custodians of law themselves indulge in obnoxious dreaded acts like rape then this is extremely painful and anguishing for the entire system said the ADJ Shakti Singh expressing his amguish.
He further added that the Uttara Pradesh police force is the largest in the country having given several brave officers with impeccable integrity. Unaccounted number of policemen have sacrificed themselves for the safety and security of human beings of the state and the country. Despite being the part and parcel of such an significant police force if the culprits Milap Singh and Veerendra Pratap of PAC had committed such an obnoxious act then there is no scope for any leniency or sympathy towards them ruled the ADJ.
Comparing this tragedy and the brutal obnoxious act by the police personnel of PAC as the non forgettable and non pardonable tragedy with Jallianwaalaa Bagh , the ADJ Shakti Singh said this act has literally shaken the soul of judiciary and entire humanity from inside, especially when women were brutally raped and incessant firing done on peaceful movement activists of Uttarakhand going to Delhi to demand their fundamental rightful separate Uttarakhand state.
While delivering the life sentence to both the culprits and fine of Rs one lakh ( Rs 50 thousand each ) etc the ADJ said this act is unimaginably most obnoxious , degrading humanity and shaking every countrymen down the spine terming this equivalent to the most horrible acts happened during Neo colonialist British Rule.
It may be recalled that several NGOs, movement activists, journalist and social organisations h individuals had filed several petitions in Supreme Court and Alahabad high court seeking justice in the 2 nd October, 1994 Rampur Tiraha dreaded tragedy in which 7 persons had died and several hapless women raped and physically assaulted. The Supreme Court had clubbed all the petitions together and send it to Allahabad High Court for hearing as the case was already being heard there. The culprits named were Anant Singh and Bua Singh apart from the PAC but of no avail. There had been hundreds of protest marches, sit ins and candle protest peaceful marches but justice was never in sight. The Uttarakhand Pradesh then CM Mulayan Singh under whose rule this dreaded tragedy happened is no more and the then Mujaffarnagar DM and the then DGP of UP had retired finally two PAC personel getting life imprisonment.
