Supreme Court’s two judge bench reserves its order for 7 May. May or may not give bail to Delhi CM Kejrival but questioned the logic of his arrest while code of conduct was in force

The plea challenging his arrest as arbitrary and illegal by the jailed AAP leader and Delhi CM Arvind Kejrival in Supreme Court has been now fixed for May 7. The two judge bench of the apex court hearing this plea of Delhi CM Arvind Kejrival said that they may or may not grant bail to him on May 7 but the Enforcement Directorate will have to justify the logic behind their act of arresting Delhi CM Arvind Kejrival in the middle of elections, just a week after the election code of conduct coming into existence. The two judge bench comprising of Justice Dipankar Dutta and Sanjiv Khanna said come what may the Enforcement Directorate would have to justify their action of arresting Delhi CM on March 21 , just a week after the election code of conduct came into existence. The two judge bench categorically said that the Enforcement Directorate will have to be ready for the possibility that the Delhi CM may get the bail in view of the real elections. However, they also said that the counsel of Arvind Kejriwal should not draw the conclusion that he will get bail as we may or may not grant bail to him. Justice Khanna said the lawyer of Arvind Kejrival should think for granted that he is getting bail though the court is open on this possibility. However, we are not saying anything either way, whether we’ll grant bail or not said justice Sanjeev Khanna while hearing the petition of Kejrival challenging his arrest as illegal. It may be recalled that the Delhi CM has been arrested on March 21 on account of his alleged involvement in a liquor scam stemming out of the new excise police of the Delhi government now turned down. The court had earlier accused Delhi CM as the Kingpin whereas the jailed Delhi CM has termed his arrest as completely arbitrary and illegal that happened for the first time destroying the tenets of democracy. Currently the former chief minister of Delhi Manish Sisodia and Arvind Kejrival is in jail in connection with the liquor scam stemmed out of the new excise policy of Delhi government with the former in jail for more than a year. Another former minister Satyendra Jain is also in Tihar jail in case of PMLA for more than two years. The Rajya Sabha MP for the second term Sanjay Singh had been to Tihar Jail for about three months but is out on bail now. After coming out on bail he was given a rousing welcome. Sanjay Singh also questioned the arrest of Arvind Kejrival saying that this is a case of clear cut murder of democracy as not a single evidence has been found against him in the case he is inside the Tihar Prison.
