SLP FILED IN SUPREME COURT AGAINST HIGH COURT OF Uttarakhand turning down the PIL earlier, admitted in Supreme Court on 12 MARCH
The two judge bench of learned justices of Supreme Court comprising of justice KM Joseph and justice Mam B. V. Nagratna have on 12 th March admitted an SLP filed by renowned advocate popular for majorly fighting Human Rights cases Colin Gonsalves on behalf of main petitioner Ashutosh Negi and others viz parents of the deceased girl Ankita Bhandari who was brutally killed in the month of September in Rishikesh Chilla barrage. The two judge bench of SC – hearing the case of Ankita Bhandari has while admitting the SLP posing several questions to state government in connection with the lackadaisical investigation of the case by SIT has also directed the counsel of state government of Uttarakhand to produce the status report of this crucial case with two weeks. The hearing took place in Court number three in the Supreme Court yesterday. The Special Leave Petition was filed against the Uttarakhand High Court verdict which had turned downed the PIL of Ashutosh Negi demanding probe by the premier investigating agency CBI. It may be recalled that a nineteen year old Ankita Bhandari was brutally killed by Pulkit Arya and two other by allegedly pushing her in Chilla canal at Rishikesh after she refused to their pressure to give special service to some VIP in Vanantara resort. This tragedy occurred in the month of September and the culprits, one of them Pulkit Arya the owner of the Vanantara, resort belonged to a family associated with the BJP. The father of the accused was state minister in earlier BJP state government and his brother was the vice chairman of SC ST commission, a state ministerial rank post while this dreaded crime was committed. After this crime both father and brother of the culprit have been expelled from the party. The case was probed by SIT formed by Uttarakhand government but the petitioner and the parents of the deceased want the CBI proble rejected by the state High Court. Certain important questions have been raised in the SLP and the main question is who is the VIP who was seen by the boy friend of the deceased and why had there been an attempt to take the buldozer at the resort to demolish it by the local MLA damaging the evidence, the charge refuted by the SIT etc. The next date of hearing is after two weeks.
