Powers given to all DMs of Uttarakhand for 3 months to enforce NSA to avert violent activities

In view of the apprehensions of possibilities of unstable situation developing in the various nooks and corners of the state, sensitive in nature like violent situations, especially as the state elections coming nearer, the state government has issued notification empowering all the district magistrates of the state to use the ” National Security Act” as a when necessary.

Under this law any person he or she could be arrested or taken into preventive detention if he or she poses threat to national security or involved in anti national activities that invites any untoward situation posing a security threat etc.to the nation or state.

According to the notification issued by Uttarakhand government signed by the additional chief secretary Anand Vardhan there is apprehension of violent activities taking place in other parts of Uttarakhand after the eruption of such activities in some districts of Uttarakhand in the past.

The notification further states that since anti social elements are creating security risks to the state by way of its adverse activities detriment to the smooth functioning of services and public order including community functions, the honourable governor has using the powers under the clause 21 of general clauses act 1897 etc given powers to all the district magistrates of the state to enforce the NSA till 31st December 2020 for three months to use the clause 3 and subclause (2).

It may be recalled that recently there has been violent incidents in Udham Singh Nagar followed by an attack on a church in Roorkee leading to a very tense situation among various communities detrimental to communal harmony and peace in the area.

The state government in order to ensure that no such situations recurs in the state and communal peace n harmony exists, it’s home department has come into action and issued this urgent notification giving powers for imposition of National Security Act to all the district magistrates of Uttarakhand for three months till 31st December, 2020.

it may be recalled that the National Security Act of 1980 is an act ratified by both the houses of parliament n promulgated on 23rd September 1980 after the president accorded the accent to this law, during the then prime minister Indira Gandhi’s regime. The NSA contains 18 sections n authorised the central and state government to take anyone into preventive custody who poses threat to Indian security. In a tweet he said that NSA has been enforced for three months as per sources. It is an exercise to scuttle the voice of the people n movements taking place in Uttarakhand. Meanwhile leader of UK Sakht Bhu Kanoon Andolan Prabhat Kumar Karal while reacting on the notification issued by Uttarakhand government said that the state government has initiated this action in desperation and frustration.

The government has realised that the inhabitants of the state are groaning and no policies of the government are being implemented for people’s well being said leader of the Bhu Sakht Kaanun Andolan Prabhat Kumar Karal.

Criticizing the BJP government for failing to successfully implemented it’s policies for the well being of UK inhabitants Saral said the elections are due after five months and the image of the ruling party has gone down as disenchanted people are on roads engaged in various movements, the one being cumulative demand for a stringent Land Act.

He accused the BJP government of trying to scuttle the cumulative voice of the people relentlessly struggling for implementation of a strong Land act in Uttarakhand. He said that a long 700 kilometre Yatra in support of Bhu Kanoon is being commenced shortly in Uttarakhand to cover Garhwal and Kumaon division. In case the government tries to stop them under guise of NSA it will have to be prepared to face the peoples disenchantment and anger n socio political consequences said Prabhat Kumar Karal in a statement.
