Delhi CM castigates centre for the ordinance against the duly elected government saying that now CM and ministers are under bureaucrats
The chief minister of National Capital Territory of Delhi Arvind Kejriwal have been meeting several opposition leaders and impressing upon them to back him in opposing the ruling political dispensation over the new ordinance of the centre to allegedly demoralise him and his government by putting bureaucrats over him and his duly elected government giving entire powers to LG of Delhi despite the Supreme Court giving tremendous powers to him and his duly elected government.
Addressing a press conference today chief minister Arvind Kejriwal while castigating the centre for imposing an ordinance on a duly elected government headed by him said that today the meeting of national civil services authority was held in Delhi for the very first time.
First let me tell you – how pre -strategically, viciously and cleverly the central government has through the imposition of an ordinance after continuously being defeated in three elections democratically, tried to capture the duly elected Delhi government.
They have written so many provisions in this ordinance said Kejrival. They have imposed a government officer ( chief secretary) over the duly elected chief minister and minister etc said Kejrival. Now in departments the say of ministers will not work but the bureaucrats will be their bosses said Kejrival.
Terming the ordinance as an instrument to capture the duly elected Delhi government through centrally sponsored bureaucrats Kejrival said that in the cabinet meetings the ministers aren’t having their say but the writ of LG and chief secretary ran literally.
They have made a so called authority in which there will be two ministers of Central government and a chief minister. This means that two officers would be dominating on the duly elected chief minister.
That means they have given the entire say to bureaucrats who will be remote controlled by the central government through services and vigilance departments said Arvind Kejrival. This means the central government wants to run the Delhi government through bureaucrats controlled by it.
He emphatically said : Our country, India is a republic and the soul of this democracy is our Constitution under whose provisions the elected governments function through its officers . These officers report to the elected governments.
In the history of entire world the Bhartiya Janta Party has for the first time hatched a conspiracy that now the bureaucrats will be above the elected government because they are controlled by the centre said Delhi CM. Kejrival said : They can control, transfer or suspend these officers now meaning these officers will now sit over the ministers in Delhi added Kejrival.
Accusing the BJP government for conspiratorially bringing the ordinance with ulterior motive against the duly elected Delhi government thrice Kejrival said : Under this ordinance now the bureaucrats will decide whether directives issued by the ministers are worth obeying or not. He said now the officer will decide whether the orders issued by the ministers are correct or not.
Now, the officer can flatly refuse to obey the minister’s directive saying that it is not correct. How will the government run this way, he asked ?
For instance if a minister says that two schools need to opened he will say there are already lots of schools. Similarly if a minister asks for opening some Mohalla clinics after talking to the common masses, the officer will say no it is not necessary.
This means that Mohalla clinic will not be made. We write the water is filthy, contaminated, the officer says no it is not. That means what he is saying is correct. Not only this but as per the ordinance whatever unanimous decisions the supreme body ( Cabinet Committee) of the elected government of Delhi will take, would be finally decided by the chief secretary.
The chief secretary will decide whether the decision taken by the supreme body of the elected government is correct or not. Then the chief secretary will recommend that decision to the LG who is fully entitled to turn down those decisions of the supreme body, ( the state cabinet ) chaired by the Delhi chief minister said annoyed Delhi CM.
He added : This power has not been given to LG even in Constitution but in this ordinance the LG has been given entire powers to turn down the unanimous decisions of the cabinet committee of the government of NCT of Delhi. Criticising the newly made Civil Services Authority by the centre Kejrival said : The formation of the civil services authority is a futile exercise and a conspiracy in which the CM has been dominated by two central bureaucrats.
You can understand this futility by an incident that happened in the last week of May said Kejrival. He said : A file came to me in the last week of May. In that file they wanted to get an officer suspended.
After reading the file I wrote seeking clarifications on four points and said – after that I will inform the date, time and venue about the meeting regarding this decision. After these queries on four points by me, the file never came back to me.
The file went to LG in which a decision was taken under the premise that since two members out of three have consented, the decision was taken. This means if I even seek clarification on any file as the member of the three member committee and, as CM too, I have no say, whatsoever.
The officer was finally,suspended after the file was sent to LG sahab. Without giving any replies to my query they have unilaterally suspended the officer concerned without my any say. Then what is the need for the authority, asked CM Kejrival.
However he added that I still have hopes from the opposition parties and honourable Supreme Court of getting justice.
