TWO JUDGE BENCH OF SUPREME COURT DIRECTS 11 CULPRITS OF BILKIS BANO CASE TO SURRENDER BEFORE JAIL AUTHORITIES WITHIN TWO WEEKS
The Supreme Court has in its historic judgement today directed the 11 convicts released in the most heart rendering Bilkis Bano case to surrender themselves before the Jail authorities in Gujarat.
The apex court has today in its judgement revoked the earlier orders of the eleven convicts released before time by the Gujarat government.
In its judgement the Supreme Court has directed all the convicts to surrender before the jail authorities within two weeks.
Dismissing the pardon order of the Gujarat government which enabled before time release of the 11 convicts of Bilkis Bano on the independence day lady year, the two judge bench comprising of justices B. V. Naagratna and Ujjwal Bhuinyan while delivering this historic decision said that the Gujarat government is not competent hence the Maharashtra government should take a decision on the release order.
While delivering the judgement, the apex court said that the Gujarat government should have filed a reconsideration / review petition against the judgement of the 13 May, 2022 of Supreme Court but it had rather snatched the powers of Maharashtra government which in the view of the Supreme Court is totally unacceptable.
This unambiguously speaks of the fact that Gujarat government has collaborated with the culprits of Bilkis Bano ruled the two judge bench of apex Court.
It catagorically stated that Gujarat state has not only misused its powers but this is a classic case of violation of the laws of the land taking advantage of the Courts lenient view giving undue and unjustifiable relief to the culprits.
It may be recalled that Bilkis Bano was just 21 years old and pregnant when the communal riots occurred and she was the tortuous victim of gang rape shamefully.
Her three years old daughter was among the seven family members who were tortuously and brutally killed during these riots.
What is shocking to note of that the Gujarat government had , taking the very lenient view of the life sentence of culprits under the guise of an obsolete law granted pardon to 11 culprits of BILKIS BANO on independence day last year.
This decision led to opposition all over the country including among opposition political parties, various social organisations, women n human right organisations and in media further leading to protest demonstrations at the pan India level etc.
The victim, Bilkis Bano was ripped apart and shocking after the release of 11 convicts saying that she wasn’t informed about this decision compelling her to knock the door of honourable Supreme Court of India finally a historic decision coming in her favour and the apex Court issuing judgement directing all the eleven culprits to surrender before the jail authorities latest by two weeks.
The leader of CPM Vrinda Karat has welcomed the judgement of Supreme Court in Bilkis Bano case saying that the SC judgement is a slap on the face of the BJP government of Gujarat.
