Supreme Court to hear review petition in NIRBHAYA of Najafgarh case on 2 nd March
The Supreme Court of India will hear the review petition on 2nd March, 2023 filed against the earlier apex Court judgement acquitting three convicts in NIRBHAYA of Najafgarh case. The review petition filed by the parents of late Kiran Negi relates to case No : RP Case No.R.P. (Crl.)No.61/2023 inCrl.A.No.611/2022 Kunwar Singh Negi And ANR is listed on 02-03-23 in Court No. By Circulation as item No.1006 Subject to Order for the day.-Supreme Court Of India ).
It may be recalled that on November 8, 2022 the earlier three judge supreme Court bench comprising of the then chief justice hon’ble U. U. Lalit , Justice Bela M. Trivedi and Justice Ravindra S Bhatt had acquitted the three convicts blaming Delhi Police for patchy investigations with lit if loop holes who had been sentenced to death by the Dwarka Sessions Court in the year 2014 and upheld by Delhi High Court too. The three convicts had approached supreme Court for relief. The case took eight prolonged years finally the convicts being acquitted due to the patchy investigations and several loopholes in the investigations by Delhi Police giving the culprits benefit of doubt.
There was outrage in Uttarakhand and at the national level as well with spate of candle marches and protest demonstrations taking place by social activists and various organisations in Delhi, NCR and Uttarakhand expressing their annoyance and disenchantment over the hon’ble apex court’s decision. Even these, days a Nyay Yatra from Delhi to Goljyu Delta temple in Kumaon demanding justice for the Nirbhaya of Najafgarh is going on in Uttarakhand by Matra Sewa Party.
What is interesting in this case was that one of the acquitted culprits had again on 26 th January allegedly murdered an Auto driver at Dwarka finally caught by police and is behind bars.
After the hon’ble apex court’s judgement a meeting was held in Garhwal Bhawan to find a legal route to file a review petition in Supreme Court which was passed by voice vote by the members of Garhwal Hiteshini Sabha and various social organisations including journalists, literatures, advocates, women representatives and retired government employees.
The general secretary of the High Court Bar Association Sandeep Sharma was given the responsibility to file a review petition in the apex Court and efforts were also made through the hon’ble Delhi LG to direct the Delhi Police to file review petitions.
Finally three review petitions were filed in Supreme Court, the first being from Kunwar Singh Negi, father if the NIRBHAYA of Najafgarh, second petition by Delhi Police and the third one by Uttarakhand Lok Manch.
After the review petitions were admitted by hon’ble supreme Court , the chief justice D. Y. Chandrachud had assured the petitioners of hearing the petition giving tremendous optimism for justice to the people of Uttarakhand and the traumatised family of late Kiran Negi . The case is due for hearing in 2 nd March.
