SUPREME COURT REFUSES TO HEAR PETITION FILED BY SANJAY SINGH AGAINST ISSUANCE OF SUMMONS BY GUJARAT TRIAL COURT AND REJECTED BY HIGH COURT

The second term Rajya Sabha MP and vociferous AAP leader Sanjay Singh who was released just a few days ago on bail after being in Tihar jail for over six months, today received a setback after the Supreme Court’s two judge bench comprising of justices B.R Gavai and Sandeep Mehta didn’t entertained the petition filed by him seeking relief over the summons issued to him as well as Delhi CM Arvind Kejrival by a Gujarat trial court over their statements on prime minister Narendra Modi’s educational qualifications n degree issue.

The Gujarat University has filed a case against Rajya Sabha MP Sanjay Singh and Delhi CM Arvind Kejrival on their statements questioning the PM’s educational qualifications.

It may be recalled that the trial court has issued summons to Sanjay Singh and Arvind Kejrival on 16 February against which they had approached the Gujarat high court and sessions court which too rejected their revision petitions finally compelling Sanjay Singh to approach the Supreme Court.

The two judge bench of the apex court in its order on Monday said that : We are not inclined to entertain the present petition adding further that the Gujarat High Court has already observed in its order that all the contentions available to the parties were kept open and the trial judge would not be influenced by any observations made in the order.

Ms Rebecca John, the counsel for Sanjay Singh MP who appeared on his behalf said to the bench that there was nothing defamatory against the Gujarat University and as such there wasn’t any need to file a defamatory case against them. They haven’t uttered anything regarding forging of degree by Gujarat University, therefore their statement was not at all defamatory to the university from any angle said Counsel for Singh , Rebecca John.

To this the two judge bench said that the matter could be argued at trial . You will get your opportunity as only prima facie cases needed at the stage of complaint said the bench .

What is important here to mention is in addition to Rebecca John, Abhishek Manu Singhvi, senior advocate who is fighting the cases of Arvind Kejrival too appeared for Singh to which the court objected to hearing two lawyers for a case saying that Rebecca John is fit enough to appear in behalf of Mr.Sanjay Singh.

Yesterday the AAP leader Sanjay Singh was on a days fast at Jantar Mantar along with ministers Atishi, Saurabh Bharadwaj, Gehlot and Gopal Rai with hundreds of leaders and activists raising slogans with postcards in their hands against the arrest of Arvind Kejrival who is currently in Tihar prison till 14 th April in judicial custody. The mass fast took place in several states including Delhi and also in several foreign countries by the followers of AAP and Arvind Kejriwal demanding his release and rousing public opinion during the ongoing general elections.
