Main accused in Ankita Bhandari case Pulkit Arya’s plea to transfer his case elsewhere rejected by Pauri session judge

The main accused in the Ankita Bhandari brutal murder case and owner of Vanantara Resort in Yamkeshwar block who’s currently behind bars, Pulkit Arya today got a huge setback when his request for transfer of his case was rejected by the sessions judge Pauri, Garhwal on Friday. While rejecting the plea of Pulkit Arya for transfer of his case elsewhere the Pauri Sessions Court ruled that all the logics given are baseless as the case is already under trial in the Additional District Judge Court Kotdwar being conducted under the relevant judicial system and as such the question of transfer of the case elsewhere does not arise. It may be recalled that the main culprit Pulkit Arya has expressed his apprehensions about not getting due justice from the Court of Additional Sessions Kotdwar. He had also raised objection and complained against the father of late Ankita Bhandari for using derogatory language against him and accused the police for presenting a men in the attire of a woman as a witness against him etc. The culprit was presenting his case himself said the ETV news report. The accused had from the Chamoli jail filed a written request for transfering his case in other court in view of his apprehensions for not granting him due justice by the additional district and sessions court , Kotdwar. He also said that while cases of 302 , murders are lying pending at Kotdwar but his case is being expedited specifically. As a result the case was transferred to Pauri sessions Court which turned down his plea as baseless and rejected it outrightly. Kindly recall that on 18 th September , 2022 , innocent girl Ankita Bhandari who was working as receptionist in Vanantara resort went missing on 18 September, 2022. Her worried father went to the revenue police at Yamkeshwar, Rishikesh to lodge the complaint but the Patwari concerned who was hand in glove with the culprit went on a leave deliberately after lodging the FIR after the intervention of journalist and activist Ashutosh Negi. On 24 September the dead body of Ankita Bhandari was found from the Chila canal in Rishikesh and three culprits arrested to be allegedly involved in her brutal murder just because she refused to submit to their incessant pressure of Pulkit Arya to oblige a so called VIP. The Yamkeshwar lawmaker had taken a bulldozer and destroyed the evidences. The factory of Ayurvedic medicines was also reported to have been burnt by the outrageous mob. Meanwhile, the traumatised parents of late Ankita Bhandari are sitting in indefinite Dharna in Srinagar, Garhwal protesting against the harrassment of journalist and activist Ashutosh Negi and his wife by arbitrarily transfering her to Pithoragarh despite her being in lower cadre including the family member of Avinash Negi who are helping the victimised family get due justice in their struggle. The parents of the deceased have also written to the DM Pauri naming the so called VIP in the case but all in vain.The Pratap Nagar lawmaker Vikram Singh Negi has also raised the issue on Friday in Uttarakhand Assembly asking for immediate justice to the family of late Ankita Bhandari.

अंकिता भंडारी नृशंस हत्या मामले के मुख्य आरोपी और यमकेश्वर ब्लॉक में वनंतरा रिज़ॉर्ट के मालिक, जो वर्तमान में सलाखों के पीछे हैं, पुलकित आर्य को आज एक बड़ा झटका लगा, जब उनके मामले को स्थानांतरित करने के उनके अनुरोध को सत्र न्यायाधीश, पौडी, गढ़वाल ने शुक्रवार को खारिज कर दिया। पुलकित आर्य की अपने मामले को अन्यत्र स्थानांतरित करने की याचिका को खारिज करते हुए, पौड़ी सत्र न्यायालय ने फैसला सुनाया कि दिए गए सभी तर्क निराधार हैं क्योंकि मामला पहले से ही अतिरिक्त जिला न्यायाधीश न्यायालय कोटद्वार में संबंधित न्यायिक प्रणाली के तहत विचाराधीन है और इस प्रकार। मामले को अन्यत्र स्थानांतरित करने का प्रश्न ही नहीं उठता। गौरतलब है कि मुख्य दोषी पुलकित आर्य ने अपर सत्र न्यायालय कोटद्वार से उचित न्याय न मिलने की आशंका व्यक्त की है। उन्होंने दिवंगत अंकिता भंडारी के पिता के खिलाफ भी आपत्ति जताई थी और उनके खिलाफ अपमानजनक भाषा का इस्तेमाल करने की शिकायत की थी और पुलिस पर उनके खिलाफ महिला की पोशाक में एक आदमी को गवाह के रूप में पेश करने आदि का आरोप लगाया था। अपराधी खुद अपना मामला पेश कर रहा था। ईटीवी न्यूज रिपोर्ट. आरोपी ने अतिरिक्त जिला एवं सत्र न्यायालय, कोटद्वार द्वारा उसे उचित न्याय न मिलने की आशंका के मद्देनजर, चमोली जेल से अपने मामले को अन्य अदालत में स्थानांतरित करने के लिए एक लिखित अनुरोध दायर किया था। उन्होंने यह भी कहा कि कोटद्वार में 302, हत्या के मामले लंबित हैं, लेकिन उनके मामले में विशेष रूप से तेजी लाई जा रही है। परिणामस्वरूप मामले को पौडी सत्र न्यायालय में स्थानांतरित कर दिया गया, जिसने उनकी याचिका को निराधार बताते हुए सिरे से खारिज कर दिया। कृपया याद करें कि 18 सितंबर, 2022 को वनंतरा रिसॉर्ट में रिसेप्शनिस्ट के रूप में काम करने वाली मासूम लड़की अंकिता भंडारी लापता हो गई थी। उसके चिंतित पिता शिकायत दर्ज कराने के लिए यमकेश्वर, ऋषिकेश में राजस्व पुलिस के पास गए लेकिन संबंधित पटवारी ने पत्रकार और कार्यकर्ता आशुतोष नेगी के हस्तक्षेप के बाद एफआईआर दर्ज करने के बाद अपराधी के साथ मिलीभगत करने वाला व्यक्ति जानबूझकर छुट्टी पर चला गया। 24 सितंबर को अंकिता भंडारी का शव ऋषिकेश में चीला नहर से मिला था और तीन दोषियों को उनकी नृशंस हत्या में कथित तौर पर शामिल होने के आरोप में गिरफ्तार किया गया था, सिर्फ इसलिए क्योंकि उन्होंने एक तथाकथित वीआईपी को उपकृत करने के लिए पुलकित आर्य के लगातार दबाव के आगे झुकने से इनकार कर दिया था। यमकेश्वर विधायक ने बुलडोजर ले जाकर सबूत नष्ट कर दिये। आयुर्वेदिक दवाओं की फैक्ट्री को भी उग्र भीड़ द्वारा जलाए जाने की खबर है. इस बीच, दिवंगत अंकिता भंडारी के आहत माता-पिता पत्रकार और कार्यकर्ता आशुतोष नेगी और उनकी पत्नी के उत्पीड़न के विरोध में श्रीनगर, गढ़वाल में अनिश्चितकालीन धरने पर बैठे हैं, जिसमें अविनाश नेगी के परिवार के सदस्य सहित निचले कैडर में होने के बावजूद उन्हें मनमाने ढंग से पिथौरागढ़ स्थानांतरित कर दिया गया है। जो पीड़ित परिवार को उनके संघर्ष में उचित न्याय दिलाने में मदद कर रहे हैं।

दिवंगत अंकिता भंडारी के माता-पिता ने मामले में तथाकथित वीआईपी का नाम लेते हुए डीएम पौड़ी को भी पत्र लिखा है, लेकिन सब व्यर्थ रहा। प्रताप नगर विधायक विक्रम सिंह नेगी ने भी शुक्रवार को उत्तराखंड विधानसभा में इस मुद्दे को उठाया और मृतक के परिवार को तत्काल न्याय देने की मांग की।
