Indian constitution grants sufficient power to judiciary for the protection of governance from the erratic politicians

The honourable supreme judiciary remains silent, when the politicians pass sarcastic remarks on judiciary’s functions. Remaining silent denotes the guilt is somewhat correct.

When they are in service, they are not acting judicially as per their own brothers remarks. Most of the judges from appex court speak loudly when they are retired and remain silent when they are on chair of justice.

Just for example, when the executive curtailed the power of CJI in selecting the CEC, by the action of parliament, CJI justice DY Chandrachud remained silent and there after the executive has misused the power of CEC.

In a democratic country, judiciary is to ensure the functioning of the executive as stipulated in constitution and laws. In one of the outspoken judge, justice Katju a retired judge from appex court was punished by supreme court, for pointing out the truth.

Looking at the US judiciary, they don’t spare the President on the point of law. President Donald Trump ordered to deny the citizenship for the children of H1 Visa holder born in USA from other countries. Immediately one of the district judge, negated the presidential order,stating that, US congress has passed a order in 1992,to give the natural citizenship to the children born in USA.

Indian constitution grants sufficient power to judiciary for the protection of governance from the erratic politicians. Such action of silence, indirectly allows the political system to dictatorship,in other words the erratic executive does what they want.
