Delhi HighCourt lawyer Rakesh Binjola and Tehsildar argue on the deployment of massive police force at IMFL shop in Rishikesh where occured a brutal murder of a handicapped boy


The Delhi High Court lawyer Rakesh Binjola representing the protestors at Khara Srot Muni Ki Reti near the disputed IMFL liquor vend had lengthy arguments with the Tehsildar at the site questioning them as to why have the administration has deputed more than fifty policemen comprising of Circle officers and inspectors etc despite they all being public servants and their duty being maintenance of law and order. He emphasised during the argument with the Tehsildar that as per the law and constitution the people have the right to peacefully protest and the police in such big numbers need to be deputed only when there is commission of crime or unlawful act. When no unlawful act has been comitted why is the police there in a ch large numbers They are not suppose to create bottleneck for the peaceful protesters to voice their grievance and protest. He catagorically said that it seems that instead of protecting the peace loving people of the area the police seems to be protecting the India Made Foreign Liquor illegal vend, its owner facilitating the sake of liquor from a vend operating from the encroached land, which is situated on the forest land and encroached upon arbitrarily where an Uttarakhand’s son has been murdered brutally the other night. Advocate Rakesh Binjola said that the statement of the Tehsildar that he does not accept his arguments amounts to violating the BNS and the Constitution and that if need be he will call the DM as well. He asserted that when the crime or any untoward situation have not been created or committed why is the police in such large numbers been deputed at the IMFL vend ? Are the Uttarakhadies in the terrorist list or the police has been call to create fear in the mind of the peaceful protectors and to safeguard the IMFL liquor vend management. It may be recalled that several protestors are peacefully staging a dharna demanding eviction of the Liquor Vend in Muni ki Reti where few days ago a young handicapped boy was brutally killed after being repeatedly stabbed more than 26 times. One of the UKD activist Mr. Badooni has sent legal notices to the Uttarakhand excise commissioner against the IMFL liquor vend built on encroached forest land questioning as to how was it allowed to exist there. The copies of the notices were sent to the secretary environment , union Government, the State DGP, the Principal conservator of Forests, Uttarakhand etc. Recently the Assistant Secretary environment has taken note of this complaint and legal notice and sent directives to the principal Conservator of Forests , Uttarakhand through a letter to immediately probe this matter in depth and take prompt action against the IMFL vend if built on the forest land arbitrarily.
Meanwhile a memorandum has been sent to DM Tehri demanding the immediate closure of the illegal IMFL vend at Muni Ki Reti, Rishikesh today. The memorandum clearly states that the IMFL liquor vend was given 100 square metre land for the vend for thred years but it has made this vend arbitrarily on 214 square metres which is in open violation of the legal norms. This fact was ascertained by the official authority during the probe. Hence the illegal IMFL vend should be closed forthwith said the memorandum.



Meanwhile large number of people in Mini ki Reti have protested and burnt the effigy of the excise commissioner for granting illegal permission for building the IMFL liquor vend in the forest land which has also encroached on the alloted area constructing the vend in 214 square yards instead of 10 square yards.
Sounds astonishing and shocking that a massive Z plus type security has been provided to an IMFL vend in Muni ki Reti , Rishikesh where brutally was murdered a young boy of 28 years who was handicapped and the sole earning Mber of his family. We have seen security of this magnitude for high profile VIPs but never to protect the interest of the IMFL vend and its owner under the guise of maintaining the law and order .
