Delhi Health minister Satyendra Jain acquitted under Benami Transactions Amendment Act 2016. Was in jail !

Finally, the credibility, honesty and transparency of the Delhi Health minister Satyendra Jain has been stamped by the judiciary in one of its judgements with Delhi CM Arvind Kejriwal reminding people about his earlier statements of the vindictive attitude of the opposition BJP often accusing the saffron party for not allowing the Delhi AAP government work independently for the good of the Delhi people. Finally his stand has been vindicated. According to reports on the basis of the supreme Court’s directives the Delhi High Court has on Monday closed all legal proceedings, against the Delhi health minister Satyendra Jain under the Benami Transaction Amendment Act 2016.

This order has been issued by the bench of justice Yashwant Verma while hearing the petitions filed by Jain and others against the case of Benami Transaction Amendment Act filed against them. The High Court had earlier on 20 th September restricted the agencies not to initiate any legal action or punitive measures on the basis of this 2016 Act, forcefully or otherwise. The court had then underlined that the Income Tax department had in another case issued a statement that though it is going against the High Court decision on the Act in order to amend the law but there won’t be any action against the petitioner. According to the NBT report in the month of August the Supreme Court had said that the Benami Transaction Prohibition ( Amendment) Act 2016 is not applicable in the cases before this act was brought into consideration. The apex Court had catagorically ruled out taking of any action before the application of this law in terms of confiscation or criminal action. The counsel for Jain said that this action of money laundering was the vindictive one political in nature amounting to vendetta of the ruling party. According to Jain this case of so called transaction was between 2011 to March 2016. Hence the amendment Act of 2016 is not applicable at all. Meanwhile, the national convenor of AAP and Delhi CM Arvind Kejriwal has in a tweet wrote : The High Court has quashed proceedings against Satyendra Jain. They have put an honest man behind bars for so many months. These people instead of wasting their time on fake cases devote time on nation building it would be better tweeted Arvind Kejriwal, enclosing the tweet if Bench and Bar which wrote : Breaking # Delhi High Court allows AAP minister Satyendra Jain’s please challenging proceedings against him under Benami Transactions Prohibition ( Amendment) Act 2016. The Court has closed all proceedings against Jain under the act tweeted Bench n Bar twitter handle.
