Vacation Bench refers to CJI Kejrival’s request to extend his interim bail till June 9 on medical grounds.
The Delhi chief minister Arvind Kejrival who is out on interim bail till June 1st has asked for extention of his interim bail till June 9 filing a special request on medical grounds that he has lost his weight, 7 kilogram a month, being on regular insulin and the doctors prescribing him several important tests the report of which will take at least a week. However, the two judge vacation bench of Supreme Court comprising of Justices J.K.Maheshwari and K.V. Vishvanathan hearing his plea being argued by the senior advocate Abhishek Manu Singhvi requesting to give his client early hearing by Wednesday , refused to entertain it saying that it would only forward the same to the Chief Justice of India for further listing and heard by him on his own wish. The vacation bench categorically said that the CJI will take the appropriate decision on listing of the matter. It may be recalled that the Delhi chief minister was arrested on the allegedly New Liquor Policy related scam on March 21 and was granted interim bail on May 10 till 1 st June to be in Tihar prisons on 2 nd June. He was granted the interim bail by Justices Dipankar Dutta and Sanjiv Khanna allowing him to campaign for his party and INDIA alliance candidates. The justices of the vacation bench said why has he approached so late and why had he not asked for extention of the interim bail while his case was being heard by Justice Dipankar Dutta and other justice. He will now have to get back to prison on 2 nd June.
According to various news reports the Delhi CM represented by Abhishekh Manu Singhvi said that his client suffers from a high risk diabetes and needs various tests to be conducted on him as advised by his doctors, the report of which will take time to come.
The CM also complained of the insensitive behaviour of the jail authorities including sudden loss of weight leading to a symptom of a life threatening disease.
Complaining about the not so good behaviour of the jail authorities holding them allegedly responsible for his bad health n losing 7 kg of weight in a month , Arvind Kejrival said that a relief of one week by extending his interim bail would amount to restoring his health and taking stock of his health condition etc.
It may be recalled that there was a controversy while Kejrival was in jail complaining about not getting regular insulin shots there when he needed them the most with Jail authorities saying to counter his statement that he deliberately ate lot of mangoes and sweets to escalate his diabetes to make a ground to seek bail on medical grounds, the charge strongly denied by him n the AAP leaders.
