After Kapil Sibal’s strong arguments the SC accorded the date of 17 May, for hearing regarding Interim bail plea
The two judge bench of the Supreme Court comprising of Justices Dipankar Dutta and Sanjiv Khanna who granted interim bail to Delhi CM Arvind Kejrival has accorded 17 May to the former chief minister of Jharkhand Hemant Soren who has also challenged his arrest in the Supreme Court through his counsel senior and outspoken advocate of Supreme Court Kapil Sibal seeking interim bail as given to the Delhi CM Arvind Kejrival who was incarcerated on March 21 on Delhi Government ‘s New Liquor Policy related scam.
According to the news report the senior advocate of Supreme Court and counsel for the former CM of Jharkhand Kapil Sibal has today put his strong points in the Court urging to prepone the date of 20 May on the plea that lot of injustice has already been done with his client Hemant Soren not giving him opportunity to campaign for his candidates being his constitutional right.
The interim bail of Hemant Soren was earlier rejected by the two judge bench of the Supreme Court where he had approached challenging his arrest as Delhi CM Arvind Kejrival did, after his plea being rejected in Delhi High Court.
The Supreme Court had after rejecting the bail to Hemant Soren had said that they will hear him during the Summer vacation but senior advocate Kapil Sibal argued and requested to give an early date to which the two judge bench finally agreed giving 17 May as the date of next hearing.
It may be recalled that there are very serious charges of PMLA under the land scam in Jharkhand against former CM Hemant Soren.
The counsel for Hemant Soren, senior advocate Kapil Sibal has asked for his interim bail as was given to Kejrival so that he too is able campaign for his party candidates.
After his plea for interim bail was cancelled , Hemant Soren challenged his arrest as arbitrary and illegal.
After Kapil Sibal strongly argued for the interim bail, the Court asked the ED to be present in the Court by issuing it a notice for 20 May to which Sibal objected saying that the date be preponed as there had already been lot of injustice done against his client Hemant Soren.
The Court finally agreed for 17 May, the last day of the SC after which the court goes on summer vacations.
Kapil Sibal while strongly arguing his case, has urged to grant interim bail to his client as he has to campaign for the last phase of polling as injustice has already been done against him.
But Court asked what will happen on 17 May, to which Sibal said why should our client be given injustice. The SC said go to High Court, we did so but the High Court had reserved our plea against arrest since February . The HC has not issued any order in March and April and on 3 rd May it was finally quashed.
We finally approached the Apex court on 6 May for immediate hearing and the result is in front of everyone. The court finally agreed to fix the date of hearing for 17 May the date in which the Courts are being closed for summer vacations.
