Big jolt to Rahul Gandhi after his plea to stay his conviction turned down by Surat Court

In a massive jolt to former Congress president Rahul Gandhi, the Surat Sessions Court, Gujarat has today rejected his plea to accord stay to his earlier order by the lower court granting him two years prison sentence and subsequent disqualification from the membership of Lok Sabha from Wayanad, Kerala constituency. The 27 page judgement quashed Rahul Gandhi’s plea on Thursday dashing his hopes to seek relief temporarily.

Congress leader Rahul Gandhi who was convicted and granted two years imprisonment by a Surat lower court on March 23 was after a day disqualified from the Lok Sabha membership in a hurried manner with Congress terming this act as a political vendetta by the ruling party.

However, Mr. Gandhi was immediately granted bail for one month after being sentenced to two year imprisonment in order to enable him apply in higher court to seek relief.

Rahul Gandhi in his plea to the Sessions Court seeking stay against his two years sentence till he is able to approach the higher court for relief had said that the Trial Court has treated him harshly , overwhelmingly influenced by his status as an MP says NDTV news.

While making the reference of the supreme Court the Session’s Court Judge said that in granting relief or pause to any decision of conviction of the lower court , the judges should exercise due caution and the judgement should not delivered be in a casual or mechanical manner in order to ensure that the public confidence in the judiciary is not shaken.

Kindly recall that a defamation case was filed against Congress leader Rahul Gandhi by the Surat lower court on March 23 by a former minister and current BJP MLA Purnesh Modi accusing him for making derogatory comments against Modi community terming them as thieves quoting the names of Lalit Modi, Nirav Modi who had fled India with bank loans worth thousands of crores etc.

Rahul Gandhi had also mentioned the name of PM Narendra Modi trying to defame him.

Rahul Gandhi had in 2019 while addressing a rally in Karnataka said how come that all thieves are having Modi surname etc. Filing his plea in the Sessions Court Rahul Gandhi has objected to the defamation suit of Purnesh Modi, MLA saying that he was not the directly affected party and those named in his speech has the legal right to file defamation petition against him not Purnesh etc.

After the latest order of the Sessions Court not giving any relief to Rahul Gandhi his sentence of two years conviction remains intact including his disqualification from Lok Sabha membership. Since he was granted bail for a month only on March 23 , the duration finishes on 23 rd April. Since now only three days are left and on 23 rd April his bail period will come to an end, Rahul Gandhi will have go in High Court for relief reveal sources, failing which he can be arrested.
