MLC and daughter of the founder of Telengana and first CM. K. Kavitha gets bail after 5 months of incarceration in Tihar jail

The daughter of the Telengana founder and CM and former MP, from 2014 to 2019, now MLC, who was incarcerated in Tihar Jail K. Kavita has been released by the Supreme Court today after the former Delhi deputy CM Manish Sisodia was released serving seventeen months long judicial custody. The MLC K. Kavitha was taken into custody by the ED and CBI as one of the key leaders of the South Lobby to allegedly bribe the Delhi CM and others in a liquor scam related to Delhi government’s new liquor policy, now scrapped.

It was believed that Rs. 45 crores out of 100 crores were paid by the Southern lobby to Delhi CM etc who had financed their Goa elections etc.

According to the latest news the bail granted to K. Kavitha has resulted in a huge jolt to the Enforcement Directorate and the Central Bureau of Investigations who had tried their level best to put her in jail.

MLC K. Kavitha got the bail in both the cases filed by the ED and the CBI.

K Kavitha was arrested on 9 th March five months ago and was granted the bail with conditions by the two judge bench of Supreme Court comprising of Justice B.R.Gavai and Justice K.V. Vishwanathan.

Similarly, the Delhi CM Arvind Kejrival is also behind bars incarcerated since March 21, in both the cases filed by the ED and CBI.

However, he was granted bail by the SC in an ED case related to the new excise policy , now scrapped but the CBI had arrested him with some credible evidence.

During the argument, the two judge bench took the decision to grant bail saying that the woman undertrials have special privileges to seek bail , hence K.Kavitha is being given bail.

The two judge bench said that there had been 493 witnesses who have been examined so far with the case comprising of 50000 pages. There is no hope of the trial to complete shortly despite the trial having been completed.

Since the women undertrials has some concessions to seek bail, the two judge bench turned down the High Court orders not to grant bail to her, and gave the bail to K. Kavitha.

The Supreme Court asked K. Kavitha, MLC to furnish the two bonds of Rs 10 lakh each and surrendering of the passport with the trial court judge.

She was also instructed not to influence the witnesses of the case further adding that under the 45 clause of the Prevention of Money Laundering Act while the women undertrials get special flexibility in seeking bail they get certain other benefits too.

The senior Supreme Court advocate Mukul Rohtagi who represented MLC K. Kavitha said that there had been no trace of any recovery in the alleged accusations that Rs 100 crores were paid by the Southern lobby to Delhi politicians.

No money trial has ever been established said Mukul Rohtagi.

There were charges that Kavitha had threatened the witness but it wasn’t proved either etc.

He also said that since she is a responsible and a respectable MLC she won’t run anywhere from justice hence is in no way any threat to the law or Court. The argument lasted for long finally K. Kavitha getting the bail after five months of incarceration in Tihar jail, Delhi.
